1. What Information We Collect and Process

a. Information You Provide to Kithery

We collect Personal Data you provide directly to us, such as:

• Account & Profile: name, email, password, photo, timezone, notification preferences.
• People & Relationships: contacts you add (e.g., names, relationship tiers/types), key dates (birthdays, anniversaries, holidays), notes, tags.
• Family Tree: relationships between people, invitations to collaborators, roles/permissions.
• Journal: entries you write, attachments you upload.
• Support & feedback: messages, survey responses, feature requests.

b. Information We Process on Your Behalf

When you add information about other individuals (e.g., to People or a Family Tree), we process that data to provide the Services. You are responsible for having the appropriate permissions to add others’ information and for honoring their requests to remove it.

c. Information We Collect Automatically

We automatically collect certain information when you use the Services, such as:

• Usage: feature interactions (e.g., calendar/list views opened), session timestamps, in-app actions.
• Device/Log: IP address, device IDs, browser/app version, OS, crash reports, diagnostic data.
• Cookies & similar tech: to keep you signed in, remember preferences, and analyze usage. See “Cookies and Similar Technologies” below.

d. Information From Integrations & Others

If you choose to connect optional integrations (for example, a calendar or contacts provider on your device or from a third party), we will request permission to access data necessary to power that feature (e.g., reading read-only calendar events to surface birthdays/anniversaries). You can revoke access at any time via the integration provider or device settings. We may also receive information if another user invites you to collaborate on a Family Tree.

2. How We Use Personal Data

• Provide the Services: create and manage your account; surface upcoming dates; power reminders and suggestions; enable People, Family Tree, Journal, and Profile features.
• Improve & develop: analyze usage, debug, enhance performance and UI, train product features (using aggregated or de-identified data where possible).
• Personalize: tailor views, suggest helpful actions (e.g., “reach out this week”), remember preferences.
• Security & integrity: detect, prevent, and respond to abuse, fraud, and security incidents.
• Communicate: send transactional messages (account, service notices), and—where permitted—product updates or surveys (you can opt out of marketing communications).
• Legal: comply with law, enforce terms, and protect the rights, safety, and property of Kithery, users, and the public.

3. How We Share Personal Data

• Service providers: hosting, storage, analytics, communications, customer support, and (when paid plans launch) payment processing. They may access Personal Data only to perform services for us and must protect it.
• Collaboration: if you invite collaborators to a Family Tree or share specific items, those collaborators can see the content you’ve shared according to the permissions you set.
• Legal & safety: to comply with law or respond to lawful requests, and to protect Kithery, our users, or the public.
• Business transfers: in connection with a merger, acquisition, or sale of assets, we may transfer Personal Data. We’ll notify you of material changes.

We do not sell Personal Data and we do not share Personal Data for cross-context behavioral/targeted advertising as defined by applicable laws. If this ever changes, we will update this Policy and provide required opt-outs.

4. International Data Transfers

We may process and store Personal Data in the United States and other countries where we or our service providers operate. When we transfer Personal Data internationally, we use appropriate safeguards (such as Standard Contractual Clauses or other lawful mechanisms) as required by applicable law.

a. Security

We use reasonable administrative, technical, and physical safeguards designed to protect Personal Data against unauthorized access, use, alteration, and destruction.

b. Retention

We keep Personal Data for as long as needed to provide the Services and for legitimate business or legal purposes. Where feasible, we will de-identify or delete data when it is no longer required. You can request deletion—see “Your Rights and Choices” below.

We use cookies and similar technologies to keep you signed in, remember preferences, and understand usage. You can control cookies through your browser settings. We may use analytics services (e.g., to understand feature adoption). If we use advertising cookies in the future, we will update this Policy and provide choices.

If data about you was added by another user (e.g., in a Family Tree), please contact that user first. We will assist where appropriate.

a. Marketing Preferences

You can unsubscribe from marketing emails via the link in the email or by contacting us. You will still receive transactional messages related to your account.

8. Region-Specific Disclosures

a. EEA/UK

When applicable, our legal bases include: performance of a contract (to provide the Services); legitimate interests (e.g., to improve and secure the Services); consent (e.g., certain notifications); and compliance with legal obligations. We will identify when consent is required and how to withdraw it.

b. California (CPRA)

We have collected in the last 12 months: identifiers (e.g., name, email), internet/network activity (e.g., usage, logs), approximate geolocation (IP), commercial information (when paid tiers launch), and inferences (to personalize experiences). We use and disclose these for the purposes described in this Policy. We do not sell or share Personal Information for cross-context behavioral advertising. You may exercise your rights as described in “Your Privacy Rights and Choices”.

9. Children

The Services are not intended for or directed to children under 16, and we do not knowingly collect Personal Data from children under 16. If you believe we have collected such data, contact support@kithery.com and we will delete it. If you add information about a minor (e.g., in a Family Tree), add only minimal information and obtain appropriate consent where required by law.

10. Third-Party Links and Features

The Services may include links, widgets, or features operated by third parties. Their privacy practices are governed by their own policies. Please review those policies before interacting with them.
